Contemporary societies are riddled with moral disputes caused by conflicts between value claims competing for the regulation of matters of public concern. This familiar state of affairs is relevant for one of the most important debates within liberal political thought: should institutions seek to realize justice or peace? Justice-driven philosophers characterize the normative conditions for the resolution of value conflicts through the establishment of a moral consensus on an order of priority between competing value claims. Peace-driven philosophers have concentrated, perhaps (...) more modestly, on the characterization of the ways in which competing value claims should be balanced, with a view to establishing a _modus vivendi _aimed at containing the conflict. _Interactive Justice _addresses an important question related to this debate: on what terms should the parties interact _during_ their conflict for their interaction to be morally acceptable to them? Although largely unexplored by political philosophers, this is a main area of concern in conflict management. Building on a proceduralist interpretation of "relational" concerns of justice, the author develops a liberal normative theory of interactive justice for the management of value conflict in politics grounded in the fundamental values of fair hearing and procedural equality. This book innovatively builds a bridge between works in political philosophy and peace studies to propose a fresh lens through which to view the normative responses liberal institutions ought to give to value conflict in politics, and moves beyond the apparent dichotomy between pursuing end-state justice through conflict resolution or peace through conflict containment. The radical changes deriving from the COVID-19 emergency have heavily upset some of the most familiar routines of daily work life. Abruptly, many workers have been forced to face the difficulties that come with switching to remote working. Basing on the theoretical framework proposed by the Job Demands-Resources model, the purpose of this paper was to explore the effect of work overload, on behavioral stress, meant as an outcome linked to the health impairment process. Furthermore, the aim of the study (...) was to explore the mediating role of job crafting, considered as a second-order construct consisting of two dimensions in the abovementioned relation. Participants were 530 workers experiencing remote working or work-from-home during the first COVID-19 lockdown in Italy. Hypotheses were explored by using three different latent variables, measured reflexively through indicators on a 5-point scale, extracted from validated questionnaires. Data analysis was performed through Structural Equation Modeling; to test the mediation, bootstrap validation was computed. Results showed that the mediation of job crafting was partial. More specifically, the direct effect between work overload and behavioral stress was positive; moreover, the indirect, negative effect through the mediation of job crafting was also significant. Therefore, results showed that job crafting can play a crucial role as a protective factor supporting the activation and adjustment of suitable resources; these resources can be useful to deal with the negative effects of work overload, particularly under the condition of heavy remote working and use of technologies, on individual outcomes. Starting from the current global scenario of the pandemic that has not yet ceased its effects, the study suggested decisive theoretical and practical implications. Accordingly, findings extended the current trends in occupational health psychology research, with special reference to the mainstream topic “work and COVID-19” in the Italian context. Finally, results can give suggestions to companies engaged in managing change, recommending that they build a collaborative workplace at the individual and collective level to implement job crafting interventions and enrich the personal and organizational resources of workers, which is useful cope with the current demands. Hume's discussion of the idea of space in his Treatise on Human Nature is fundamental to an understanding of his treatment of such central issues as the existence of external objects, the unity of the self, the relation between certainty and belief, and abstract ideas. Marina Frasca-Spada's rich and original study examines this difficult part of Hume's philosophical writings and connects it to eighteenth-century works in natural philosophy, mathematics and literature. Focusing on Hume's discussions of the infinite divisibility of (...) extension, the origin of the idea of space, geometry, and the notion of a vacuum, she shows that the central questions of Hume's 'science of human nature' - what does the 'science of human nature' reveal about the mind and its operations? what is experience? - underlie all of these discussions. This article contributes to the debate concerning the identification of politically relevant cases of corruption in a democracy by sketching the basic traits of an original liberal theory of institutional corruption. We define this form of corruption as a deviation with respect to the role entrusted to people occupying certain institutional positions, which are crucial for the implementation of public rules, for private gain. In order to illustrate the damages that corrupt behaviour makes to liberal democratic institutions, we discuss the (...) case of health care professionals’ abuse of their right to conscientious objection to abortion services. We show that the conscience clause can be instrumentally abused to sabotage democratically established public rules and thus exert undue private influence on their implementation. In this sense, from a liberal democratic perspective, institutional corruption is problematic because it is disruptive of such fundamental liberal ideals as the impartiality of public institutions and citizens’ political equality. This chapter examines Edmund Husserl’s notion of idea in the Kantian sense with the aim of clarifying the distinction between ideas and essences. In particular, the chapter focuses on the occurrences of the notion of idea in the Kantian sense in Ideas I, identifies its core features, and explains why the notion of idea should not to be conflated with the phenomenologically relevant notion of essence. The chapter then points to doubts about the givenness of ideas in the Kantian sense (...) and argues that, once the notions of essence and of idea are disentangled, those doubts have no bearing on whether essences merit a place within phenomenology. Whistleblowing” has entered the scholarly and the public debate as a way of describing the exposure by the member of an organization of episodes of corruption, fraud, or general abuses of power within the organization. We offer a critical survey of the main normative theories of whistleblowing in the current debate in political philosophy, with the illustrative aid of one of the epitomic figures of a whistleblower of our time: Edward Snowden. After conceptually separating whistleblowing from other forms of wrongdoing (...) disclosures, we introduce and discuss two families of normative views of this practice: the “Extrema Ratio” and the “Deontic” views. We show how the two views can be usefully considered in tandem to offer an all-round assessment of the moral justification of whistleblowing either as an extraordinary individual conscientious act of indictment or as an ordinary dutiful organizational practice of answerability that enables the capacity of self-correction of an organization. Austerity politics, war in the Middle East and at other borders of the European Union, the rise of nationalisms, the emergence of populist parties and politicians, Islamophobia and the refugee crisis are amongst the recent developments suggesting the need for discussions about the theories and concepts that academic disciplines provide for making sense of societal, cultural and political transformations. In this article, we focus on the capacities of feminist political theories to undertake this task. By assessing different feminist approaches to (...) political analysis that range from focusing on women and men, to analysing gender, to doing intersectionality and to adopting post-structural and new materialist approaches, we explore the contributions and the limitations of each framework. This allows us to consider where feminist theoretical debates on gender and politics currently are, to assess old and new developments and to address lacunae in the debate. Our argument is that dominant approaches in political science influence the emergence and marginalisation of particular feminist frameworks for political analysis, but also that feminist theorising of gender and politics, in striving for recognition within mainstream political science, reproduces its own hegemonies and marginalisations. This article offers a conceptual framework for discussing the role of envy within processes of transitional justice. Transitional justice importantly includes the transformation of intergroup dynamics of interaction in the aftermath of societal conflicts and upheavals. Such transformation aims to realise “interactive” justice in transitional justice by reshaping belief and value systems, and by moulding emotional responses between the involved parties. A nuanced understanding of the emotions at play in intergroup antagonistic dynamics of interaction is thus essential to transitional justice. (...) Among the many emotions that we could address in such scenarios, we target envy. Envy, in its various forms, features prominently in many societal conflicts and upheavals, and has, therefore, the potential to undermine or, conversely, support just intergroup interactions. However, the ambivalent role of this emotion has been scantly analysed in the philosophical literature on transitional justice. We make a start on filling this lacuna by developing a conceptual framework which is necessary to appreciate how envy and its varieties are epistemically and practically relevant to realising interactive justice in transitional justice processes. Can the quality of gender+ equality policies be defined in ways that apply across different policy contexts and different policy moments? In light of different scholarly debates and empirical material from gender violence policy debates especially in Southern and Central Eastern Europe, this article discusses dilemmas around defining the quality of gender+ equality policies. It proposes a two-dimensional model. The first dimension links quality to procedural aspects: empowerment of women’s rights advocates at different stages of the policy process, and transformation (...) with reference to prevailing contextual legacies. The second dimension is more substantive, and includes genderedness, intersectionality and the structurally transformative focus of policies. The article illustrates how within the framework set by these criteria, the quality of gender equality policies is constructed through policy debates in ways that are dependent on the different discursive, institutional and structural factors specific to various policy contexts. As the source of cosmic motion as well as a restless figurality, labile and polyvocal, the receptacle/chōra offers a fecund zone of destabilization that allows for an immanent critique of ancient metaphysics. This article aims to investigate the way in which a political theory of justice should respond to the endorsement of pluralism. After offering reasons in support of the necessity for such a theory to take pluralism seriously, an argument is put forward for its characterization in minimal and procedural terms. However, taking issue with the straightforward relationship of implication identified by a number of scholars between pluralism and procedural justice, this article contends that a direct relation can only be established (...) between pluralism and the need to define a minimal theory of justice, i.e. a theory that assumes as little as possible in terms of values and views of the world. Its procedural formulation is seen, instead, as a consequence of the limited predictive power of theory facing the heterogeneous situations with which it is expected to deal. (shrink)

Greco-Roman antiquity is often presumed to provide the very paradigm of Western humanism. This paradigm has been increasingly thrown into question by new theoretical currents such as posthumanism and the "new materialisms", which point toward entities, forces, and systems that pass through andbeyond the human and which dislodge it from its primacy as the measure of things. Antiquities beyond Humanism seeks to explode this presumed dichotomy between the ancient tradition and the twenty-first century "turn": fourteen original essays explore the myriad (...) ways in which Greek and Roman philosophy and literature can be understood as foregrounding the non-human rather thansimply reflecting the ideals of classical humanism. Greek philosophy is filled with metaphysical explanations of the cosmos grounded in observations of the natural world. Other areas of ancient humanistic inquiry - ethics, poetry, political theory, medicine, rhetoric - extend into the realms ofplant and animal life, even stone life, continually throwing into question the ontological status of living and non-living beings. By casting the non-human or more-than-human in a new light in relation to contemporary questions of gender, the environment, and networks of communication, the volumedemonstrates that encounters with ancient texts, experienced as both familiar and strange, can help forge new understandings of life, whether understood as zoological, physical, psychical, ethical, juridical, political, divine, or cosmic. This study investigates the risk and return characteristics of impact investing in the public equity market. We use a unique hand-collected dataset of 50 US listed firms whose product (or service) addresses at least one of the global social and environmental challenges, as defined by the United Nations Social Development Goals (SDGs). We designate such firms Impact Firms, and we compare their financial performance to a matched sample of Non-Impact Firms in the time span 2002–2019. Our results show that Impact (...) and Non-Impact Firms have similar level of financial performance and both volatility and systemic risk over the entire sample period. At the same time, Impact Firms show a slightly lower negative skewness of the returns over the entire sample period, but not during crisis periods. However, compared to matched Non-Impact Firms, Impact Firms outperform during periods of market crisis, generating a valuable dampening of downside risk. (shrink)

We study a system, μŁΠ, obtained by an expansion of ŁΠ logic with fixed points connectives. The first main result of the paper is that μŁΠ is standard complete, i.e., complete with regard to the unit interval of real numbers endowed with a suitable structure. We also prove that the class of algebras which forms algebraic semantics for this logic is generated, as a variety, by its linearly ordered members and that they are precisely the interval algebras of real closed (...) fields. This correspondence is extended to a categorical equivalence between the whole category of those algebras and another category naturally arising from real closed fields. Finally, we show that this logic enjoys implicative interpolation. (shrink)

Liberal theories of justice typically claim that political institutions should be justifiable to those who live under them – whatever their values. The more such values diverge, the greater the challenge of justifiability. Diversity of this kind becomes especially pronounced when the institutions in question are supra-national. Focusing on the case of the European Union, this paper aims to address a basic question: what kinds of value should inform the justification of political institutions facing a plurality of value systems? One (...) route to an answer is provided by John Rawls, who famously distinguishes between comprehensive and political values, and defends the exclusion of the former from the foundations of a political theory of justice. This paper questions the tenability of the Rawlsian solution, and draws attention to an alternative twofold conceptual distinction: that between minimal and non-minimal and between substantive and procedural values. Minimal values are meant to be as independent as possible of controversial conceptions of the good and views of the world, regardless of whether these are comprehensive or purely political. It will be argued that their endorsement may thus further specify the nature of what should be shared in order to justify political institutions in conditions of pluralism. In order to further refine the account of such basis of justification, two variants of minimalism will be presented according to whether they invest substantive or procedural values. Substantive values qualify the property of an outcome; procedural values qualify the property of a procedure. The latter part of the paper consists of a ‘face-off’ between minimal proceduralism and minimal substantivism, considering reasons in favour of the adoption of each. The result, we suggest, is a helpful reorientation of the political dimension of the value debates to which the multiplicity of values amid contemporary European horizons give rise. (shrink)

The Italian code of medical deontology recently approved stipulates that physicians have the duty to inform the patient of each unwanted event and its causes, and to identify, report and evaluate adverse events and errors. Thus the obligation to supply information continues to widen, in some way extending beyond the doctor-patient relationship to become an essential tool for improving the quality of professional services.

Post-Cartesian Occasionalism argues that the power of causing an effect depends on knowledge of the means by which the effect is produced. The argument is used to deny finite beings the power to act. Arnold Geulincx expresses this thesis in the principle Quod nescis quomodo fiat id non facis. Here, my purpose is to show that: 1. The philosophical problem that is at the origin of the principle Quod nescis quomodo fiat id non facis originates in Galen’s De foetuum formatione, (...) a work translated into Latin only in 1535. 2. Important works of early modern philosophy, such as Campanella’s Del senso delle cose e della magia, discuss Galen’s text. 3. Due to their rejection of teleology, Descartes’ physics and metaphysics are completely foreign to the Quod nescis principle. Comparing the Cartesian theory of animal-machines with the theory of animal behavior of Pierre Chanet, a philosopher who adopts the principle, confirms this claim. (shrink)

In Italy in recent years, an exponential increase in the frequency of medical malpractice claims relating to the issue of informed consent has substantially altered not only medical ethics, but medical practice as well. Total or partial lack of consent has become the cornerstone of many malpractice lawsuits, and continues to be one of the primary cudgels against defendant physicians in Italian courtrooms. Physicians have responded to the rising number of claims with an increase in ‘defensive medicine’ and a prevailing (...) preoccupation with the purely formal aspects of consent. The result is a plethora of consent forms, believed to be a guarantee of ‘informed consent’, as well as a growing reliance on informed consent as a shield against judicial action brought by the patient. Physicians ‘inform’ patients without really sharing information, often delegating the task of communication to other professionals who are not doctors. Italian judges always condemn the physician when information to the patient has been inadequate, thus leading insurance companies to consider the lack of valid informed consent as the total responsibility of the physician and/or the hospital. It is necessary to change tack, to remove this idea of consent which permeates the defensive culture of medical practice. Italian physicians need to be trained, first of all, to become aware that information and consent are two distinct processes, albeit closely connected. Valid communication demands a higher level of professionalism from physicians. (shrink)

The paper articulates a new understanding of individual responsibility focused on exercises of agency in reason-giving rather than intentional actions or attitudes towards others. Looking at how agents make sense of their actions, we identify a distinctive but underexplored space for assessing individual responsibility within collective actions. As a case in point, we concentrate on reason-giving for one's own involvement in systemic corruption. We characterize systemic corruption in terms of its public ‘unavowability’ and focus on the redescriptions to which corrupt (...) agents typically resort to vindicate their actions. Through a multidimensional approach to reason-giving, we show that the individual rationalisations these redescriptions point to are necessarily less-than-successful since they keep thedifferent categories of reasons involved in making sense of one’s own conduct misaligned. We argue that this involves a kind of tainted reasoning at the interface between epistemic vice and epistemic disadvantage. We then consider such test cases as self-deception, wilful ignorance, and actions on ‘autopilot’ to show that tainted reasoning is constitutive of systemic corruption, not merely caused by it. On this ground, we expound a new view of responsibility centred on reason-giving as the epistemic core which all responsibility assessments track. To demonstrate the interest of this view, we compare it with existing alternatives revolving around the ideas of accountability and attributability. We conclude by showing how our understanding of responsibility can shed new light on the analysis and normative assessment of an agent’s responsible ignorance. (shrink)

This article explores EU gender policy through the lens of the `Wollstonecraft dilemma', a guiding conceptual device that helps to summarize women's difficult path towards equality in a patriarchal system. EU gender policy reflects the contradictions women must face in their struggle for equality, which are common to most public gender policies. All provisions devised to progress in gender equality have negative retroactive effects on women, due to the patriarchal context in which they are applied. Empirical evidence from the Spanish (...) case offers further support to the argument, showing how EU gender policy is still trapped in the `Wollstonecraft dilemma'. A more holistic approach to EU gender policy, able to tackle all the areas of which patriarchy is composed, and an improved monitoring of EU gender policy implementation in the member states, could both generate a more effective gender policy in the EU and make further progress in solving the dilemma. Questo articolo offre una difesa dell'approccio procedurale alla giustizia rispetto alle critiche che ne evidenziano l'indeterminatezza normativa. A questo fine, l'articolo inizia con la presentazione di un modello di proceduralismo capace di rivelare la specificità di questo approccio alla giustizia rispetto alle alternative orientate agli esiti. La difesa di questo modello di proceduralismo si avvale di due strumenti che, all’interno del pensiero democratico liberale, sono stati invocati spesso quali canali di contestazione degli esiti politici e legali: la disobbedienza civile e (...) l’obiezione di coscienza. Per i proceduralisti, la prima può essere indirizzata verso gli esiti di procedure ingiuste, mentre la seconda ha a che fare con l’incongruenza tra le proprietà di un qualche esito e gli impegni morali personali (non pubblici) altrimenti perseguiti dalle parti interessate. In questo modo, l’analisi dell’obiezione di coscienza sembra essere capace di rivelare le basi sulle quali esiti proceduralmente giusti possono essere contestati ed esenzioni da essi richieste. Questa conclusione mira a chiarire in quale senso sia possibile ricomporre i conflitti tra le richieste della giustizia (procedurale) e quelle derivate dalle lealtà morali personali delle parti interessate, mostrando in questo modo l’appeal di un approccio procedurale alla giustizia in condizioni di disaccordo morale. The corruption of public officials and institutions is one of the most obvious problems that affects developed and developing countries alike. Because this view is largely shared, most current studies of this phenomenon—‘political corruption’—have been dedicated either to measuring or counteracting the negative political, social, and economic effects that this form of corruption may have in society. Albeit significant and urgent, these studies have distracted the attention of commentators from a somewhat more basic analysis of the nature and wrongness of (...) this phenomenon. This lacuna has resulted in the formulation of a multiplicity of actions that address a very heterogeneous set of issues, including such diverse phenomena as bribery, embezzlement, institutional malfunctioning, the inadequacy of political leaders, and clientelism. This situation is unsatisfactory because it muddles important distinctions between different pathologies that may affect the public order. But it matters also for the design of anti-corruption strategies that risk to either misfire or be too vague by lacking a clear target and an account of the exact kind of wrong these strategies are meant to prevent and/or correct. In our research on this topic, we have addressed this issue by offering a normative analysis of political corruption as surreptitious public action. Our account explains the distinguishing traits of political corruption and makes sense of its inherent wrongness as a contradiction of the logic of publicity that undergirds political interactions in a rights-based system. In this chapter, we draw on this research and expand it with a view to enhancing the identification of relevant instances of political corruption and the design of policies to counteract them. Against a background of neoliberal precarity, the yoga industry promotes a practice experienced by, and inscribed on, the body that is meant to transcend physiological boundaries and expand individual and collective awareness. In this context, research on contemporary yoga has shed light on how women, and specific notions of womanhood, are key to a promise of wellness, healing, and self-realisation that is materialised by White, monied, slender female practitioners as embodiments of the proper way of undertaking self-care. The yoga industry, (...) thus, participates in a politics of the body, embedded in the intricate structures of the current neoliberal politico-economic regime. Based on these observations, this article sets out to interrogate how the yoga industry’s mandate of tending to the body enters the way female teachers and practitioners navigate, experience, and express their journey into yoga. By analysing selected interviews conducted with women yoga instructors and practitioners in the city of Genoa, the article examines how they frame yoga as a way of caring for the self while navigating personal issues and bodily ailments. As a path of self-scrutiny and self-realisation, yoga is talked about as providing some relief from life’s predicaments and embodied vulnerabilities while also accommodating gender normativity. The article develops a critique of the problematic appropriation of self-care by the yoga industry’s mainstream cultural repertoires as a sociologically neutral individual response to living with neoliberal precarity. The article contends that feminist politics of care provide a framework to re-inscribe yogic self-care within a broader process of collectively subverting neoliberal injunctions about tending to the body.
